PLEASE READ THESE TERMS CAREFULLY. SECTION 20 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION AND JURY TRIAL WAIVER THAT AFFECT HOW DISPUTES ARE RESOLVED. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS AS DESCRIBED IN SECTION 20.8.
1. Agreement to These Terms
These Terms of Service ("Terms") are a binding agreement between you and MarketCatalyst Analytics LLC, a Texas limited liability company ("MarketCatalyst," "we," "us," or "our"), and govern your access to and use of the MarketCatalyst website at marketcatalyst.ai, the web app at app.marketcatalyst.ai, and related APIs, content, and services (the "Service").
By creating an account, purchasing a subscription, or otherwise accessing or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not access or use the Service.
2. Description of the Service
MarketCatalyst provides market data, market recaps, earnings and analyst-action summaries, SEC filing data, screeners, data visualizations, watchlist and portfolio-tracking tools, AI-generated summaries, and related financial commentary, strictly for informational and educational purposes.
We are not a registered investment adviser, broker-dealer, or financial planner. We do not manage client assets, execute trades, route orders, or hold customer funds or securities, and we do not provide personalized investment advice or recommendations to buy, sell, or hold any security. Some features let you set your own automated data alerts or show algorithmic ratings; these are impersonal data tools, as described in Section 6, and are not trade recommendations or stock picks.
Trading stocks, options, and other financial instruments carries inherent risk, including the possible loss of principal. Please consider your own financial goals, time horizon, and risk tolerance, and consult a qualified financial professional before making any investment decision.
3. No Investment Advice; No Fiduciary Relationship
Nothing on the Service constitutes, or should be relied upon as, investment, legal, tax, accounting, or financial advice, or a recommendation, offer, or solicitation to buy or sell any security, instrument, or asset. All content is general and impersonal and is not tailored to your financial situation or objectives. You are solely responsible for evaluating the merits and risks of any investment decision, and you should consult a qualified, licensed financial advisor before making one.
No fiduciary, advisory, or client relationship is created between you and MarketCatalyst by your use of the Service, including features that display or analyze your own holdings, watchlists, or portfolio performance. Past performance, historical reactions, "typical moves," and similar statistics do not guarantee future results.
4. AI-Generated Content
Parts of the Service, including "AI read" summaries, "What Matters Now," recaps, audio summaries, earnings reads, portfolio summaries, and information extracted from images you upload, are generated wholly or partly by artificial intelligence ("AI Output").
AI Output may be inaccurate, incomplete, outdated, or misleading, and may misstate facts, figures, or the reasons a security moved. AI Output is generated automatically, is not reviewed by a licensed professional before it is shown to you, and is not investment advice. Do not rely on AI Output as a statement of fact or as the basis for any investment decision. Verify important information with original sources (such as company filings and your broker) before acting on it.
5. Market Data; Delayed, Estimated, and Simulated Data
- Third-party data. Market, pricing, news, fundamental, analyst, and other data on the Service is obtained from third-party data providers, exchanges, public sources (such as SEC EDGAR), and other sources ("Third-Party Data"). We do not control and are not responsible for Third-Party Data. Neither we nor our data providers guarantee that Third-Party Data is accurate, complete, timely, or in sequence, and neither we nor they will be liable for any errors, omissions, interruptions, or delays in it, or for any action you take in reliance on it.
- Delayed and real-time data. Depending on your plan, data may be real-time, delayed, or end-of-day. Each panel indicates whether its figures are live or end-of-day where we can do so, but you should not assume any figure is real-time.
- Estimated, illustrative, and simulated data. Certain data, including some options figures, may be estimated, illustrative, or simulated for educational or demonstration purposes. Always confirm prices and quotes with your broker before trading.
- Provider terms. Third-Party Data remains subject to the rights and restrictions of its providers. Our data providers may require you to agree to additional terms or confirm your subscriber status (for example, whether you are a "professional" or "non-professional" user) before you receive certain data. Unless we agree otherwise in writing, data is provided for your personal, non-commercial use only.
6. Alerts, Ratings, Screeners, and Portfolio Tools
The Service may include user-configured data alerts (for example, price, volume, earnings, or filing notifications), custom alert rules, screeners, relative-strength ranks, technical ratings (such as "Buy" or "Strong Buy" labels), sentiment indicators, and tools that display or summarize your own holdings. These features are automated, impersonal data tools. They are not recommendations to buy, sell, or hold any security, are not stock picks or trade signals provided by us, and do not take your personal circumstances into account.
Alerts may be delayed, fail to trigger, trigger in error, or be delivered late or not at all because of data, network, device, or service issues. Do not rely on alerts for time-sensitive trading decisions.
7. Eligibility and User Accounts
- You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, to use the Service.
- The Service is intended for users in the United States. You may not use the Service if you are located in, or are a resident of, a country or region subject to comprehensive U.S. sanctions, or if you are on any U.S. government list of prohibited or restricted parties.
- You must provide accurate, current information when creating an account and keep it up to date.
- You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account.
- Accounts are for individual use only; you may not share your account or credentials with any other person.
- You must notify us promptly at contact@marketcatalyst.ai of any unauthorized use of your account.
8. Acceptable Use
You agree that you will not:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Use the Service to engage in, facilitate, or promote market manipulation, insider trading, "pump-and-dump" schemes, spoofing, front-running, or any other violation of securities or commodities laws;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, models, or underlying methodology of the Service, except to the extent applicable law expressly permits despite this restriction;
- Scrape, crawl, harvest, or systematically download or extract content or data from the Service by automated means, except through the APIs and export features we provide and in accordance with Section 9;
- Copy, redistribute, resell, sublicense, publish, broadcast, or display data or content from the Service to any third party, or make it available through any other product or service, except as expressly permitted by these Terms;
- Use the Service, or any data or content from it, to build, train, fine-tune, or improve a competing product or service, or any artificial intelligence or machine learning model;
- Share, sell, rent, or otherwise transfer your account, paid access, credentials, or API keys to any other person or entity;
- Circumvent any usage limits, plan restrictions, paywalls, or security or access controls;
- Use the Service to transmit spam, malware, or other harmful code, or to harass, abuse, defame, or harm any person or entity;
- Upload content that you do not have the right to upload or that infringes anyone's intellectual property, privacy, or other rights;
- Interfere with or disrupt the integrity or performance of the Service; or
- Attempt to probe, scan, or test the vulnerability of the Service, or attempt to gain unauthorized access to our systems, accounts, or networks.
9. API Access and Data Export
If your plan includes API access or data export features ("API Features"):
- Use. You may use API Features only for your own personal, internal research, in accordance with these Terms, our documentation, and any usage limits we set.
- Keys. API keys are confidential and personal to you. You are responsible for all use of your keys and must notify us promptly if a key is compromised.
- Limits. We may set and change rate limits, quotas, and other technical limits, and may throttle or suspend API Features to protect the Service or our data providers.
- No redistribution. You may not redistribute, resell, sublicense, publish, or display data obtained through API Features to any third party, use it in any public-facing or commercial product or service, or use it to train or improve any AI or machine learning model.
- Provider restrictions. Some data may not be available for export or may be subject to additional restrictions required by our data providers.
- Changes. We may modify, suspend, or discontinue API Features or any endpoint at any time, and may revoke API access if we believe it is being misused.
10. Intellectual Property and License to Use the Service
- MarketCatalyst Analytics LLC and its licensors own all right, title, and interest in and to the Service, including its software, design, compilations, articles, analysis, AI Output, and other proprietary content (collectively, "Our Content"), except for Third-Party Data and Your Content. The Service is protected by copyright, trademark, and other laws.
- Subject to these Terms and payment of any applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service and Our Content for your personal, non-commercial use.
- You may not copy, reproduce, distribute, publicly display, or create derivative works from Our Content without our prior written permission, except for personal, non-commercial use or as otherwise expressly permitted by these Terms. Downloadable recaps and exports are for your personal use only.
- "MarketCatalyst" and our logos and product names are our trademarks. You may not use them without our prior written permission.
- All rights not expressly granted to you are reserved.
11. Your Content and Feedback
- Your Content. You retain ownership of content you submit to the Service, such as portfolio holdings, watchlists, alert rules, images you upload (for example, through "Import from photo"), comments, and messages ("Your Content"). You grant MarketCatalyst a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display Your Content as needed to operate, provide, secure, and improve the Service, including processing it with our service providers as described in our Privacy Policy. We will not publicly display your portfolio holdings or uploaded images.
- Your responsibility. You represent that you have the rights needed to submit Your Content and that it does not violate any law or anyone's rights.
- Feedback. If you send us suggestions, ideas, or other feedback about the Service, we may use it for any purpose without restriction or obligation to you.
12. Subscriptions, Billing, Auto-Renewal, and Cancellation
- Plans. We offer a free plan and paid subscription plans. The features, price, and billing period of each plan are shown on our pricing page and at checkout.
- Automatic renewal.Paid subscriptions automatically renew at the end of each billing period (for example, monthly) for the same period at the then-current price, and your payment method will be charged automatically, unless you cancel before the renewal date. Before you purchase, we will clearly show the price, billing frequency, and the fact that your subscription renews automatically, and we will ask for your consent. After purchase, we will send you a confirmation email that includes these terms and how to cancel.
- Authorization. By purchasing a subscription, you authorize us and our payment processor to charge your payment method the applicable fees, plus any applicable taxes, at the start of each billing period until you cancel. Fees are charged in advance.
- How to cancel. You may cancel at any time, online, through your account settings, or by emailing contact@marketcatalyst.ai. Cancellation takes effect at the end of your current billing period. You keep access to your paid features until then, and you will not be charged again.
- Refunds. Because you can cancel at any time, we do not provide refunds or credits for partial billing periods or unused time, except as required by law or as we may decide in our discretion. If you believe you were charged in error, contact us at contact@marketcatalyst.ai within 60 days of the charge.
- Free trials and promotions. If we offer a free trial or promotional price, we will disclose its length, the price you will be charged afterward, and how to cancel before you sign up. Unless you cancel before the trial or promotional period ends, your subscription will convert to a paid subscription and you will be charged the regular price. Where required by law, we will remind you before the trial ends. Trials are limited to one per customer per plan.
- Price changes. We may change subscription prices. We will give existing subscribers at least 30 days' advance notice by email before a price change takes effect. If you do not want to pay the new price, you may cancel before it takes effect; otherwise, the new price will apply starting with your next billing period after the change takes effect.
- Plan changes. If you upgrade or downgrade, the change and any resulting charge or credit will be explained when you make the change.
- Failed payments. If a payment fails, we may retry the charge and may suspend or downgrade your paid features until payment is made.
- Taxes. Prices do not include taxes unless stated. You are responsible for any applicable sales, use, or similar taxes.
13. Copyright Complaints (DMCA)
We respect intellectual property rights. If you believe material on the Service infringes your copyright, send a notice to our designated copyright agent that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and where it is located on the Service; (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Copyright Agent: MarketCatalyst Analytics LLC, Attn: Copyright Agent, by email to contact@marketcatalyst.ai (subject line: "DMCA Notice").
If your content was removed and you believe it was removed by mistake, you may send a counter-notice as permitted by 17 U.S.C. § 512(g). We may terminate the accounts of repeat infringers.
14. Third-Party Services and Links
The Service may link to or integrate with third-party websites and services, including sign-in providers (such as Google), payment processors, data providers, and brokers. We do not control and are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.
15. Disclaimer of Warranties
THE SERVICE, OUR CONTENT, AI OUTPUT, THIRD-PARTY DATA, AND ALL OTHER CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, OR TIMELINESS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT ALERTS WILL BE DELIVERED, OR THAT ANY DATA, ANALYSIS, OR AI OUTPUT WILL BE ACCURATE, COMPLETE, OR CURRENT. YOU USE THE SERVICE AND RELY ON ANY CONTENT AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
(A) IN NO EVENT SHALL MARKETCATALYST ANALYTICS LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR DATA PROVIDERS (THE "MARKETCATALYST PARTIES") BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY TRADING OR INVESTMENT LOSSES, LOST PROFITS, LOST OPPORTUNITIES, OR LOSS OF DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY CONTENT, AI OUTPUT, THIRD-PARTY DATA, OR ALERTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND
(B) THE TOTAL LIABILITY OF THE MARKETCATALYST PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (1) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (2) ONE HUNDRED U.S. DOLLARS (US $100).
THESE LIMITATIONS APPLY TO ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
17. Indemnification
You agree to indemnify, defend, and hold harmless the MarketCatalyst Parties from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with (a) your access to or use of the Service, (b) Your Content, (c) your violation of these Terms, (d) your violation of any law or regulation, including securities laws, or (e) your violation of any rights of a third party. We may assume control of the defense of any matter subject to indemnification, and you agree to cooperate with our defense.
18. Suspension and Termination
- By us. We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law or by our data providers, to protect the Service or other users, or if we discontinue the Service. If we terminate your paid subscription without cause, we will refund any prepaid fees for the unused portion of your current billing period. If we terminate because you violated these Terms, you will not receive a refund.
- By you. You may stop using the Service, or close your account, at any time. Closing your account does not automatically cancel a paid subscription if it is billed through a third party; cancel any paid subscription as described in Section 12.
- Effect. Upon termination, your right to access the Service ends immediately, and we may delete your account data in accordance with our Privacy Policy. Any fees owed before termination remain due.
19. Governing Law and Venue
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Texas and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict-of-laws principles. Subject to Section 20, any dispute that is not subject to arbitration will be resolved exclusively in the state or federal courts located in Collin County, Texas, and you and we consent to the personal jurisdiction of those courts.
20. Dispute Resolution; Binding Arbitration; Class Action Waiver
20.1 Informal dispute resolution first. Before starting arbitration or a small-claims action, you and we each agree to try to resolve any dispute informally. The party with the dispute must send a written notice to the other ("Notice of Dispute") that includes the party's name and contact information, the email address associated with the account (if any), a description of the dispute, and the relief requested. Send your Notice of Dispute to MarketCatalyst Analytics LLC by email to contact@marketcatalyst.ai, with the subject line "Notice of Dispute." We will send ours to the email address associated with your account. If the dispute is not resolved within 60 days after the Notice of Dispute is received, either party may start arbitration or a small-claims action. Statutes of limitations and filing-fee deadlines are tolled during this 60-day period.
20.2 Agreement to arbitrate. Except as provided in Sections 20.3 and 20.8, you and MarketCatalyst agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your relationship with us, whether based on contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether it arose before or after you agreed to these Terms ("Dispute"), will be resolved by final and binding individual arbitration, and not in court. The Federal Arbitration Act governs the interpretation and enforcement of this Section 20.
20.3 Exceptions. Either party may (a) bring an individual claim in small-claims court if the claim qualifies and remains in that court on an individual basis, and (b) seek injunctive or other equitable relief in court to stop actual or threatened infringement, misappropriation, or violation of its intellectual property rights or of Sections 8 or 9.
20.4 Arbitration rules and procedure. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect (the "AAA Rules"), as modified by this Section 20, before a single arbitrator. The AAA Rules are available at www.adr.org. Payment of filing, administrative, and arbitrator fees will be governed by the AAA Rules. The arbitration will take place in the county where you live or in Collin County, Texas, or by video or telephone conference, as the arbitrator determines; if your claim is for $10,000 or less, it may be decided on written submissions alone. The arbitrator may award the same individual relief a court could award, but only in favor of the individual party seeking relief and only to the extent needed to provide relief for that party's individual claim. The arbitrator's award is final and binding, and judgment may be entered on it in any court of competent jurisdiction. Except as provided in Sections 20.5 and 20.7, the arbitrator decides all issues, including the scope and enforceability of this Section 20.
20.5 Class action and jury trial waiver. YOU AND MARKETCATALYST AGREE THAT EACH MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims (except as provided in Section 20.6) and may not preside over any form of class, collective, or representative proceeding. YOU AND MARKETCATALYST EACH WAIVE THE RIGHT TO A JURY TRIAL. A court, not an arbitrator, will decide any dispute about the validity, scope, or enforceability of this Section 20.5.
20.6 Mass arbitration. If 25 or more demands for arbitration that raise substantially similar claims are filed against us by or with the help of the same or coordinated counsel or organizations ("Mass Filing"), the following applies, in addition to the AAA's Mass Arbitration Supplementary Rules where applicable: (a) the demands will be administered in batches of up to 25 demands each, with one arbitrator assigned per batch, and only one batch will proceed at a time; (b) the first batch will be selected by counsel for the claimants and us in equal parts, and the remaining demands will be held in abeyance, with no AAA fees owed for them, until the prior batch is resolved; (c) the parties will mediate the remaining demands in good faith after the first batch is resolved; and (d) statutes of limitations for held demands are tolled from the date the demand was filed until it is placed in a batch. A court in Collin County, Texas has authority to enforce this Section 20.6 and to enjoin a Mass Filing or the assessment of fees that does not comply with it.
20.7 Severability of this Section. If the class action waiver in Section 20.5 is found unenforceable as to any claim or request for relief, then that claim or request (and only that claim or request) will be severed and decided by a court under Section 19, after all individual claims are resolved in arbitration, and the remainder of Section 20 will still apply. If any other part of this Section 20 is found unenforceable, the rest of this Section 20 will remain in effect.
20.8 30-day right to opt out. You may opt out of this agreement to arbitrate by emailing contact@marketcatalyst.ai, with the subject line "Arbitration Opt-Out," within 30 days after you first agree to these Terms. Your email must include your name and the email address associated with your account, and a clear statement that you want to opt out of arbitration. If you opt out, Section 19 will govern all Disputes, but Section 20.5 (class action and jury waiver) will still apply to the extent permitted by law. Opting out does not affect any other part of these Terms or any earlier arbitration agreement you made with us.
20.9 Changes to this Section. If we make a material change to this Section 20, we will give you at least 30 days' notice by email. You may reject the change by emailing contact@marketcatalyst.ai within 30 days after the change takes effect, in which case the most recent version of this Section 20 that you accepted will continue to apply.
21. Changes to the Service and to These Terms
- Service changes. We may add, change, suspend, or discontinue any part of the Service, including features, data sources, and plan contents, at any time.
- Terms changes. We may update these Terms from time to time. We will post the updated Terms on the Service and change the "Last Updated" date. If we make material changes, we will notify you by email at least 15 days before they take effect (or sooner if required by law, for security reasons, or for new features). Changes will not apply retroactively and will not apply to any Dispute of which we had actual notice before the change took effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and cancel any paid subscription.
22. General Terms
- Entire agreement. These Terms, together with our Privacy Policy and any additional terms you agree to for specific features or data, are the entire agreement between you and us about the Service and supersede all prior agreements and understandings.
- Severability. If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible (except as stated in Section 20.7), and the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms, including in connection with a merger, acquisition, reorganization, or sale of assets. Any attempted assignment in violation of this section is void.
- Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, government action, power or internet failures, cyberattacks, failures of hosting or cloud providers, exchange or market closures or outages, or failures or delays of data providers.
- Export and sanctions. You agree to comply with all applicable U.S. export control and economic sanctions laws and not to use, export, or re-export the Service in violation of them.
- Electronic communications and notices. You consent to receive communications from us electronically, including by email and through the Service, and agree that they satisfy any legal requirement that communications be in writing. We may send notices to the email address associated with your account. Notices to us, including legal notices, must be sent by email to contact@marketcatalyst.ai.
- Relationship. You and we are independent parties. These Terms do not create any partnership, joint venture, employment, agency, or fiduciary relationship.
- No third-party beneficiaries. These Terms do not give any rights to third parties, except that the MarketCatalyst Parties are intended beneficiaries of Sections 15, 16, and 17.
- Headings. Headings are for convenience only and do not affect interpretation. "Including" means "including without limitation."
23. Survival
Sections 3, 4, 5, 6, 10, 11, 12 (as to fees owed before termination), and 15 through 24 survive any termination or expiration of these Terms or your account, along with any other provision that by its nature should survive.
